General Terms and Conditions

Article 1 - Definitions

The following definitions apply in these general terms and conditions:

  • Cooling-off period: Period during which the consumer can exercise his right of withdrawal.
  • Consumer: A natural person who acts outside a professional or commercial sphere and enters into a distance contract with a business.
  • Day: Calendar day.
  • Continuous transaction: Distance contract that includes a series of products or services whose delivery and/or purchase obligation is distributed over a given period of time.
  • Durable medium: Any medium that enables the consumer or business to store personally identifiable information in a manner that is accessible in the future and remains unchanged.
  • Right of withdrawal: The possibility for the consumer to withdraw from the distance contract within the cooling-off period.
  • Entrepreneur: Natural or legal person who offers products and/or services to consumers through an organized distance sales system.
  • Distance contract: Agreement in which only distance communication is used until the moment of conclusion of the contract.
  • Distance communication: Means of concluding a contract without the consumer and the entrepreneur being physically present in the same place.
  • General Terms and Conditions: These general conditions of the entrepreneur.

Article 3 - Applicability

  1. These general terms and conditions apply to all offers made by the entrepreneur and to all distance contracts concluded between the entrepreneur and the consumer.
  2. Before a distance contract is concluded, the consumer will be provided with a copy of these terms. If this is not possible, the consumer will be informed how he or she can access them free of charge.
  3. If distance contracts are concluded electronically, the text of these conditions may be provided to the consumer electronically, so that it can be easily stored on a durable medium.

Article 4 - The offer

  1. If an offer has a limited period of validity or is subject to conditions, this will be explicitly stated in the offer.
  2. The offer is non-binding. The entrepreneur reserves the right to modify and adjust the offer.
  3. The images, descriptions and data in the offer are indicative and cannot give rise to compensation or termination of the contract if they contain obvious errors.

Article 5 - The contract

  1. The contract is considered concluded when the consumer accepts the offer and meets the established conditions.
  2. If the contract is concluded electronically, the entrepreneur shall immediately confirm receipt of the acceptance.

Article 6 - Right of withdrawal

  1. The consumer has the right to withdraw from the contract within 14 days of receiving the product , without having to justify the reason.
  2. During this period, the consumer must handle the product and its packaging with care. It may only be used to the extent necessary to assess whether it is to be kept.
  3. To exercise the right of withdrawal, the consumer must notify the entrepreneur in writing or by email within the established period.

Article 7 - Costs in case of withdrawal

  1. The costs of returning the product will be borne by the consumer.
  2. If the consumer has already made a payment, the entrepreneur will refund the amount within 14 days of receiving the return.

Article 8 - Exclusion of the right of withdrawal

The right of withdrawal may be excluded for:

  1. Customized products according to consumer specifications.
  2. Hygiene items if the seal has been opened.
  3. Products that cannot be returned due to their nature or that deteriorate quickly.

Article 9 - Price

  1. Prices indicated during the validity of the offer will not be increased, except for changes in tax rates.
  2. Prices do not include customs fees, import taxes or other additional costs that will be the responsibility of the customer.

Article 10 - Conformity and warranty

  1. The entrepreneur guarantees that the products comply with the contract, the specifications offered and the current legal regulations.
  2. Defects or incorrectly delivered products must be reported to the entrepreneur within 14 days of delivery.

Article 11 - Delivery and execution

  1. The entrepreneur will endeavour to execute orders with the utmost care.
  2. If delivery cannot be made within the agreed time, the consumer will be informed within 30 days of placing the order.

Article 12 - Payments

  1. Payments must be made within 7 business days of the start of the cooling-off period.
  2. The consumer is responsible for reporting errors in payment data in a timely manner.

Article 13 - Complaints procedure

  1. Complaints about contract performance must be submitted within 7 days of discovering the problem.
  2. The entrepreneur will respond to complaints within 14 days of receipt.

Article 14 - Applicable law

All contracts between the entrepreneur and the consumer are subject exclusively to the laws of the Netherlands, even if the consumer resides abroad.
